These Terms govern your access to and use of the Source Platform, which connects Requesters with Providers and Collection Owners for physical-archive research services.
Welcome to Source ("Platform," "we," "us," or "our"), operated by Be My Source. These Terms and Conditions ("Terms") govern your access to and use of our Platform, which connects individuals seeking access to physical information resources in libraries and archives ("Requesters") with individuals who have physical and institutional access to such resources ("Providers").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.
Source is a peer-to-peer marketplace platform that enables users to connect with one another for research assistance services. Users may serve as both Requesters (seeking access to materials) and Providers / Collection Owners (facilitating access to materials), creating a community of mutual research support.
The Platform supports two primary use cases:
The Platform does not provide library services directly. We facilitate connections between users who independently contract for access assistance services.
To use the Platform, you must:
You must create an account to use the Platform. You agree to provide accurate, truthful, and complete information; maintain and update your information; maintain the security and confidentiality of your account credentials; and notify us immediately of any unauthorized access or security breach.
You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.
These responsibilities apply to individual Providers offering services through personal institutional access. Institutions that provide services directly through their own staff are governed by separate Institutional Service Provider Terms.
As a Provider, you represent, warrant, and agree that you have legitimate physical and institutional access to the libraries, archives, or institutions you represent; will comply with all institutional policies, access agreements, and terms of use; will respect and adhere to all copyright laws, fair use provisions, and intellectual property rights; are providing services for your time and effort in locating, accessing, and facilitating access to materials, not for the content itself; will not reproduce, scan, photograph, digitize, or copy materials in whole or in substantial part unless explicitly permitted; will maintain accurate records of your institutional affiliations; will immediately notify Requesters and the Platform if your institutional access is revoked or restricted.
As a Collection Owner sharing access to your personal physical collections, you represent that you own or have lawful possession of all materials; have the legal right to share access; will comply with copyright law when sharing materials; will accurately describe materials; will not share access to materials that you know or reasonably should know are counterfeit, stolen, or unlawfully obtained; will maintain materials in reasonable condition; will clearly communicate any access restrictions, handling requirements, or limitations on use; understand that you retain all ownership rights to your physical materials; will not use the Platform to facilitate the sale of materials.
As a Requester, you represent that you will use materials obtained through the Platform solely for legitimate educational, research, or scholarly purposes; will comply with all applicable copyright laws; understand that you are paying Providers or Collection Owners for their time and effort in facilitating access, not for the content itself; will not request materials or services that would violate copyright law, institutional policies, or ethical standards; will not redistribute, republish, or commercially exploit any materials obtained through the Platform beyond what is legally permitted; accept full responsibility for ensuring your use of materials complies with applicable laws; will treat Collection Owners' personal materials with appropriate care.
All users agree not to: request or provide access to materials in violation of copyright law; engage in systematic downloading, scanning, photographing, or mass reproduction of copyrighted materials; use the Platform to facilitate copyright infringement; request or provide materials for commercial resale or distribution; reproduce entire works or substantial portions thereof without explicit legal authorization; circumvent technological protection measures or digital rights management systems; misrepresent institutional affiliations or access privileges; misrepresent ownership or possession of personal collections; share account credentials; use the Platform for any illegal, fraudulent, or unauthorized purpose; harass, abuse, or harm other users; damage, deface, or mishandle Collection Owners' personal materials; sell, trade, or commercially distribute physical materials; interfere with or disrupt the Platform or servers; circumvent platform delivery by exchanging materials via external email, file-sharing services, or direct communication; share personal contact information for the purpose of conducting transactions off-platform.
We reserve the right to monitor user activity and transactions for compliance; investigate reported violations; request verification of institutional affiliations and access credentials; require Providers and Collection Owners to provide proof of legitimate access; review communications between users where abuse is suspected; review uploaded content when investigating copyright claims or user disputes; implement automated systems to detect patterns of systematic copying; suspend accounts pending investigation; share information with rights holders, institutions, or law enforcement when legally required; implement rate limits or restrictions on user activity to prevent abuse. Users expressly consent to such monitoring as a condition of using the Platform.
Providers must verify their institutional affiliations upon request. Collection Owners may be required to verify ownership or lawful possession of materials. We may conduct periodic re-verification of user credentials. Failure to verify when requested may result in account suspension or termination. Users agree to cooperate fully with verification requests within 7 days.
For individual Providers and Collection Owners:
Providers and Collection Owners are compensated for their time, effort, and expertise in locating requested materials within institutional or personal collections; physically accessing libraries, archives, special collections, or personal materials; documenting and facilitating access; complying with institutional procedures and copyright restrictions; handling, preserving, and managing access to personal collection materials; uploading completed work through the Platform's secure delivery system.
Individual Providers receive 85% of the Research Fee. Source retains 15% platform commission.
Providers and Collection Owners are NOT compensated for the content of materials themselves. The Platform does not facilitate the sale of physical materials.
The Platform charges service fees on transactions, which include platform commission (15% of Research Fee), payment processing fees, file hosting and secure delivery infrastructure fees (included in platform commission), and other applicable charges. These fees cover secure file upload and storage infrastructure, encrypted delivery system, payment processing, platform maintenance and support, copyright compliance and monitoring systems, transaction management and dispute resolution. Service fees will be clearly disclosed before any transaction is completed.
(a) Requester has 7 days from Provider upload to download materials. (b) Download links are valid for 7 days from upload. If Requester downloads within the final 48 hours of the 7-day window, the link remains valid for 48 hours after download to enable dispute filing and verification.
(c) Once Requester downloads materials, they have 48 hours to raise a dispute regarding content, quality, accuracy, or completeness. (d) Disputes must be filed through the Platform's dispute resolution system within the 48-hour window after download. (e) Disputes filed after 48 hours are not eligible for Platform mediation.
A transaction is marked complete when: (f) Requester downloads materials AND 48 hours pass without dispute being filed, OR (g) 7-day download window expires without download (auto-completion), OR (h) An active dispute is resolved in Provider's favor.
(i) If a dispute is filed within 48 hours of download, the transaction is blocked from completion until the dispute is resolved. (j) Payment to Provider is withheld during active disputes. (k) Files are preserved beyond normal retention periods during active dispute resolution.
(l) Provider payment is processed within 7 business days after transaction is marked complete. (m) Payment cannot be processed while transaction is blocked by active dispute.
(n) If Requester does not download materials within 7 days of upload, the transaction is automatically marked complete, Provider payment is processed, and Requester forfeits access to materials.
All payments must be made through the Platform's approved payment methods. The Platform may withhold payments pending dispute resolution or investigation of Terms violations. All fees are non-refundable except as specifically provided in our Refund Policy.
Users are responsible for all applicable taxes associated with their use of the Platform. Providers and Collection Owners are responsible for reporting and paying all taxes on income earned through the Platform.
We may implement limits on the number or frequency of transactions per user; restrict access to users exhibiting patterns consistent with mass reproduction; trigger review and temporary holds for unusually high transaction volumes; refuse to process payments for transactions that appear to violate copyright law or these Terms; permanently restrict accounts repeatedly flagged by rights holders or institutions.
Source operates as an intermediary marketplace that facilitates research transactions between users. (a) Transactional file hosting: when a Provider completes a research job, they upload materials to Source's servers solely for the purpose of transmitting those materials to the specific Requester who commissioned the work. (b) Temporary storage: files are stored temporarily and automatically deleted 7 days after transaction completion OR 30 days after Provider upload, whichever comes first. (c) No content database: Source does not build a searchable database of user-uploaded materials. (d) Automated delivery: upon Provider upload, Requesters receive email notifications from no-reply@bemysource.com with secure download links. (e) No content selection or control: Source does not select, review, edit, or modify content before transmission. (f) Intervention only on notice: Source intervenes only when a copyright holder submits a valid infringement notice, a user files a formal dispute, we receive reports of illegal content or Terms violations, or as required by law. (g) User-generated content: all materials transmitted through the Platform are user-generated content.
(h) Transaction integrity: all deliverables must be transmitted through Source's delivery system. (i) Prohibited circumvention: users may NOT exchange materials via external email, file-sharing services, or direct delivery. Circumventing the platform delivery system constitutes breach of contract and may result in account termination and forfeiture of payment.
(j) Source operates as a service provider under UK Copyright, Designs and Patents Act 1988 and Electronic Commerce Regulations 2002, US Digital Millennium Copyright Act (DMCA) 17 U.S.C. § 512, and EU Digital Services Act (DSA). (k) We maintain proper notice-and-takedown procedures, act expeditiously to remove allegedly infringing material upon receiving valid notice, and maintain a repeat infringer policy. (l) As a transient transmission and temporary storage service provider, we are not liable for copyright infringement by users where we store materials at user direction without selection or modification.
(a) Provider upload: files are transmitted via encrypted connection (TLS 1.3) and stored on Source's secure servers. (a1) File limitations: maximum file size of 100MB per file, maximum 10 files per transaction, total upload size per transaction may not exceed 500MB. (b) Unique transaction storage: each upload is accessible only to the designated Requester. (c) Automated notification: Requester receives an automated email upon successful upload. (d) Access control: download links are unique and non-transferable.
(e) Retention period: uploaded files are automatically deleted 7 days after transaction is marked complete OR 30 days after Provider upload, whichever comes first. (f) Dispute exception: files involved in active disputes are preserved beyond the 30-day maximum until dispute resolution is complete. (g) Complete removal: upon deletion, files are permanently removed from production servers and from all backup systems within 14 days. (h) No permanent storage: Source does not maintain any permanent archive of user-uploaded research materials.
(i) Early deletion requests: users may request immediate deletion by contacting support@bemysource.com. (j) Download copies: Requesters should download their materials promptly and maintain their own copies. (k) Download deadline: Requesters must download materials within 7 days of Provider upload. (l) No download forfeiture: if Requester does not download within 7 days, transaction is automatically marked complete and Provider payment is processed.
Source does not routinely review uploaded content, monitor file contents for copyright compliance, screen materials prior to making them available, or exercise editorial control. Source may review specific uploaded content only in response to valid copyright infringement claims, during dispute investigation, when investigating suspected Terms violations, or as required by law.
Source reserves the right to remove, delete, or disable access to any user-uploaded content that violates these Terms, infringes copyright, is subject to a valid DMCA / copyright takedown notice, contains illegal or harmful material, or violates platform policies. Upon receipt of valid copyright notice, Source will expeditiously remove or disable access. Source will notify the uploading user (except where prohibited by law). Users may submit counter-notifications per Section 7.4.4. Source is not liable to users for removal or deletion of content.
The Platform takes copyright protection seriously. All users must comply with applicable copyright laws in their jurisdiction, respect intellectual property rights, adhere to fair use (US) or fair dealing (UK) principles and limitations, follow the specific copyright policies of each library, archive, or institution, and (for personal collections) ensure that sharing access to materials does not violate copyright law.
For UK users: fair dealing provisions under UK copyright law are narrow and apply only to specific purposes. For US users: fair use provisions under US copyright law are context-specific and determined by a four-factor test. For EU users: copyright exceptions vary by member state. Not all educational or research uses qualify as fair use or fair dealing. Each use must be evaluated based on the applicable legal framework. Institutional and publisher policies may impose restrictions beyond statutory requirements. Users bear the legal responsibility for ensuring their use complies with copyright law in their jurisdiction.
We have a zero-tolerance policy for copyright infringement. If we determine that a user has systematically violated copyright restrictions, facilitated mass reproduction of copyrighted materials, engaged in unauthorized commercial distribution, or otherwise violated copyright law through Platform use, we will immediately suspend or terminate the user's account and may report violations to appropriate authorities and rights holders.
We respect intellectual property rights and comply with applicable copyright laws including UK law and the US Digital Millennium Copyright Act (DMCA). UK-based rights holders: contact our Copyright Infringement Contact at copyright@bemysource.com. US-based rights holders (DMCA): contact our designated DMCA Agent at dmca@bemysource.com. EU-based rights holders: submit complaints under the Digital Services Act (DSA).
If you believe material was removed or access was disabled as a result of mistake or misidentification, you may submit a counter-notification. We will process counter-notifications in accordance with applicable law.
In accordance with applicable laws and in appropriate circumstances, we will terminate the accounts of users who are repeat infringers. Three-strike system: users receiving three valid copyright infringement notices within a 12-month period will have their accounts permanently terminated. Serious violations: single instances of egregious infringement may result in immediate permanent termination. Appeal process: users may appeal infringement determinations within 14 days. We maintain records of infringement notices for legal compliance purposes and share infringer information with rights holders when legally required.
All content on the Platform, including text, graphics, logos, software, and other materials (excluding user-generated content), is owned by or licensed to Be My Source and is protected by intellectual property laws.
We respond promptly to inquiries from institutions, investigate reports of users misusing institutional access, share information about violations with affected institutions when legally permitted, and provide rights holders with information necessary to pursue infringement claims. Institutions and rights holders may contact us at institutions@bemysource.com, copyright@bemysource.com (UK), or dmca@bemysource.com (US).
We provide users with educational resources regarding copyright law basics, institutional access policies, proper citation practices, and permitted uses. However, these resources do not constitute legal advice, and users remain solely responsible for ensuring their compliance with applicable law.
When a Requester and Provider connect through the Platform to complete a research transaction, they form an independent service agreement for that specific job. The Platform facilitates transactions by providing matching and communication, payment processing, transactional file delivery, transaction management, and dispute resolution assistance.
Despite providing these services, Source does NOT become a party to the underlying service agreement; guarantee the quality, accuracy, or legality of Provider services; control how Providers conduct research or what they upload; verify that uploaded materials comply with copyright law; have any obligation to review content before transmission; or warrant that materials are non-infringing.
The Provider alone is responsible for determining what materials to access and reproduce, ensuring compliance with copyright law and institutional policies, the content, quality, and legality of uploaded deliverables, and appropriate use of fair dealing / fair use provisions. The Requester alone is responsible for specifying appropriate research requests, using received materials in compliance with copyright law, and not requesting materials that would require copyright infringement.
Source is a platform provider, not a library or archive, an educational institution, a publisher or rights holder, an agent of any user, or a party to service agreements between users.
For transactions involving personal collections: Collection Owners are solely responsible for the condition, authenticity, and legal provenance of their materials. The Platform makes no representations or warranties regarding materials in personal collections.
Providers and Collection Owners are independent contractors and not employees, agents, partners, or representatives of Source or Be My Source. They have no authority to bind the Platform, are solely responsible for their own taxes, insurance, and regulatory compliance, determine their own methods, schedule, and means of providing services, are free to provide services through other platforms or channels, and bear all costs and expenses related to providing their services.
By using the Platform, you expressly acknowledge and agree that you are solely responsible for determining whether your use of materials complies with copyright law; the Platform does not provide legal advice; you are responsible for understanding and complying with institutional access policies; violation of institutional policies or copyright law may result in institutional sanctions or legal liability; the Platform's facilitation of a connection does not constitute approval or guarantee that any particular use of materials is legal; the Platform may monitor activity and disclose information to institutions, rights holders, or authorities; Source hosts and transmits user-uploaded materials as an intermediary service; all file uploads and downloads are logged for transaction tracking and copyright compliance; Source may review uploaded content in response to copyright claims or Terms violations; Source will cooperate with copyright holders and law enforcement regarding uploaded content.
The Platform operates independently of libraries, archives, and educational institutions. We do not control institutional access, policies, or operations. Individual Providers with institutional access represent and warrant that their use of Platform does not violate institutional access agreements, they have reviewed and will comply with institutional policies, they will immediately cease offering services if institution prohibits such activity, and they will notify Platform if institutional access is revoked or restricted.
(a) Exclusive delivery method: all research materials, documents, scans, photographs, and other deliverables MUST be exchanged through the Platform's official delivery system. (b) Upload requirement: Providers must upload all deliverables through the Platform interface. (c) Email notifications: Requesters receive delivery notifications from Source (no-reply@bemysource.com). (d) Download access: Requesters access materials by clicking download links in Source emails. Downloads are tracked for transaction completion and dispute resolution purposes.
(e) No external file sharing: users may NOT exchange deliverables via personal email, external file sharing services (Dropbox, Google Drive, WeTransfer, etc.), direct physical delivery, or any method outside Source's delivery system. (f) No contact information exchange: users may NOT share personal email addresses, phone numbers, or other contact details for the purpose of circumventing the Platform delivery system. (g) Privacy protection: the mandatory platform delivery system protects user privacy. (h) Platform efficiency: centralized delivery enables transaction tracking, dispute resolution, copyright compliance monitoring, and quality control.
(i) Circumventing the platform delivery system is a material breach of these Terms and may result in immediate account suspension, forfeiture of payment for the transaction, permanent account termination for repeat violations, and legal action to recover platform fees. (j) Users agree that any attempt to conduct transactions off-platform constitutes intentional evasion of service fees and breach of contract.
Users must maintain professional, respectful, and lawful conduct at all times. We prohibit harassment, intimidation, or threats; discriminatory or hateful speech or conduct; fraudulent or deceptive practices; spamming or unsolicited commercial communications; and any conduct that violates applicable laws or regulations.
All content shared on the Platform must comply with applicable laws, respect intellectual property rights, be accurate and not misleading, and not contain malware, viruses, or harmful code.
We reserve the right to monitor user activity and content, remove content that violates these Terms, suspend or terminate accounts for violations, and report illegal activity to authorities.
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our Privacy Policy.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee the availability, quality, or reliability of Provider or Collection Owner services; that Requesters will find Providers or Collection Owners for their needs; that materials requested will be available or accessible; the condition, authenticity, or completeness of materials in personal collections; that Collection Owners accurately represent their materials; or uninterrupted or error-free operation of the Platform.
Users acknowledge that they are solely responsible for compliance with applicable laws; the Platform does not provide legal advice regarding copyright or intellectual property; users should consult legal counsel regarding their specific situations; the Platform is not responsible for users' legal violations; the Platform makes no determination regarding fair use or fair dealing; the Platform does not verify, endorse, or guarantee that Providers have legitimate institutional access; the Platform does not verify ownership of personal collections; users access materials entirely at their own risk; Source hosts and transmits user-uploaded materials as an intermediary; all uploads and downloads are logged; Source may review uploaded content in response to copyright claims or Terms violations; Source will cooperate with copyright holders and law enforcement regarding uploaded content.
THE PLATFORM does not determine or advise whether any use of materials constitutes fair use or fair dealing; does not guarantee that Providers will comply with institutional policies or copyright restrictions; does not verify that materials accessed are in the public domain; does not endorse or authorize any particular use of copyrighted materials; cannot and does not guarantee that users will not face legal liability for copyright infringement; does not monitor all transactions for copyright compliance; does not review all uploaded content before transmission to users.
BY USING THE PLATFORM, YOU ACKNOWLEDGE THAT you may face legal liability, including statutory damages, if you infringe copyright; institutions may revoke access privileges or impose sanctions for policy violations; rights holders may pursue legal action against you for infringement; "I found it on Source" is not a defense to copyright infringement; the Platform's facilitation of a connection does not constitute legal authorization to use copyrighted materials; temporary file hosting for transaction purposes does not constitute review or approval of content.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BE MY SOURCE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR: any indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or use; damages arising from user interactions or disputes; copyright infringement or intellectual property violations by users; institutional sanctions or access revocation affecting users; damage to, loss of, or disputes regarding materials in personal collections; misrepresentation of materials by Collection Owners; content uploaded by users to the Platform; removal or deletion of user-uploaded content.
FOR INDIVIDUAL USERS (Providers, Requesters, Collection Owners): IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO THE PLATFORM IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) £100.
These limitations do not apply to liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, intellectual property infringement, wilful misconduct or gross negligence, or any other liability that cannot be excluded or limited by applicable law.
You agree to indemnify, defend, and hold harmless Be My Source and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Platform; your violation of these Terms; your violation of any law or rights of third parties; copyright infringement or intellectual property violations; your service agreements with other users; content you upload to the Platform; (for Collection Owners) any claims regarding ownership, condition, or authenticity of materials; (for Requesters) any damage to or loss of materials from personal collections.
You may terminate your account at any time by following the account closure process on the Platform. You remain responsible for all obligations incurred before termination.
We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms, engage in fraudulent or illegal activity, we receive reports of copyright infringement, your institutional access is revoked, required by law or legal process, we determine in our sole discretion that your continued use poses risks, or you circumvent the platform delivery system.
Upon termination, your access to the Platform will cease immediately. Outstanding financial obligations remain due. Sections of these Terms that by their nature should survive will continue to apply.
While not required, we strongly recommend that Providers maintain professional liability insurance, Collection Owners maintain appropriate insurance for valuable materials, and all users understand that the Platform's liability limitations mean you bear significant personal risk. This is a recommendation only and not a contractual requirement.
Before initiating formal proceedings, users agree to contact us to seek informal resolution of disputes.
The following disputes are not subject to arbitration and may be brought in court: claims in small claims court or equivalent, intellectual property disputes, claims seeking injunctive relief, and claims required by law to be heard in court.
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform with an updated "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of modified Terms. Material changes will be communicated via email or Platform notification.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, AND DISCHARGE BE MY SOURCE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, AND LIABILITY ARISING FROM OR RELATED TO: copyright infringement claims by third parties arising from your use of materials; institutional sanctions, access revocation, or disciplinary action against you; legal claims by rights holders for your unauthorized use of copyrighted materials; disputes with other users regarding services, materials, or payments; damage to, loss of, or theft of materials from personal collections; inaccurate representations by other users; your reliance on the Platform's services; any violation of institutional policies or access agreements; financial losses resulting from transaction disputes; any indirect, consequential, or incidental damages whatsoever; content uploaded by users; removal or deletion of uploaded content; temporary hosting of user-uploaded materials.
You acknowledge that this waiver is a material inducement for us to provide the Platform and that we would not offer these services without it.
These Terms are governed by the laws of England and Wales. However, where you are located in a jurisdiction with mandatory consumer protection laws, nothing in these Terms affects your statutory rights under those laws.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
The following sections survive termination: Section 5 (User Responsibilities and Prohibited Activities), Section 6.4 (Taxes), Section 7 (Copyright Compliance and Intellectual Property), Section 8.5 (Independent Contractor Relationship), Section 8.6 (Express User Acknowledgments), Section 8.7 (Institutional Relationships), Section 8.8 (Platform Delivery System), Section 11 (Disclaimers and Limitations of Liability), Section 14.5 (Comprehensive Waiver and Release), Section 15 (General Provisions).
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Be My Source.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.
These Terms do not create any third-party beneficiary rights.
We are not liable for failures or delays caused by circumstances beyond our reasonable control.
